A Decree of the People of Los Angeles Concerning Garcetti’s Memorandum

We the People (hereinafter, “The People”) of Los Angeles, do hereby decree that the City of Los Angeles has passed, enacted, and is attempting to enforce the unlawful Ordinance No. 187134 (hereinafter, “The Ordinance”), which will be harmful to The People. The Ordinance is in violation of the Los Angeles City Charter, and repugnant to both the U.S. Constitution and the California Constitution.

The People are aware of a memorandum dated October 28, 2021 from our public servant, Mayor Eric Garcetti (hereinafter, “Mayoral Servant”) to “All City Department Heads” of subject “City of Los Angeles Response to the COVID-19 Pandemic: Re: Mandatory Implementation of Non-Compliance with the Requirements of [the Ordinance]”.

Let this memorandum be known as “Garcetti’s Memorandum.” Our Mayoral servant is putting both Los Angeles and the City of Los Angeles at great and unnecessary risk via Garcetti’s Memorandum. Our public servants, the employees and officers of the City of Los Angeles (hereinafter, “Our Servants”), have all sworn Oaths to uphold and defend both the U.S. Constitution and the California Constitution pursuant to California Constitution Article XX Section 3:

Members of the Legislature, and all public officers and employees, executive, legislative, and judicial, except such inferior officers and employees as may be by law exempted, shall, before they enter upon the duties of their respective offices, take and subscribe the following oath or affirmation: […] I will support and defend the Constitution of the United States and the Constitution of the State of California against all enemies, foreign and domestic; […]

The People receive services such as policing, fire-fighting, sanitation, energy production, water services, and others for the furtherance of safety and well-being.  These essential services are conveyed to The People via the efforts of Our Servants.  The Ordinance creates no obligations of any kind whatsoever towards any of Our servants as The People decree it null and void being contrary to Our supreme Law, the U.S. Constitution pursuant to Article VI clause 2:

This Constitution, [...] shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

Garcetti's Memorandum contains language imposing upon Our Servants obligations that do not exist, and, furthermore, create a dichotomy of disloyalty and imperilment: either a servant will comply with the unlawful Ordinance or be removed via Garcetti's Memorandum.  Should the stipulations of the Ordinance be enacted, any servant enacting such will be in breach of his or her Oath; alternatively, should the stipulations of Garcetti's Memorandum be enforced, Our Servants will be unjustly removed from their posts or offices, and without due process.  The removal of Our Servants on grounds of the memorandum will be in such gross numbers and at such reckless speed as to put both Los Angeles and the City of Los Angeles in grave jeopardy. 

We the People address Our Our Mayoral Servant with these questions:  Who upholds our laws when you retain only unfaithful police who do not defend our supreme Law?  Who extinguishes our conflagrations after you lay aside all but few and exhausted fire-fighters?  Who provides our energy after you drive away those skilled to produce it?  Who brings precious water to our parching city after you banish those who would deliver it?

We the People acknowledge Our Mayoral Servant, Eric Micheal Garcetti, bound by sworn Oath, deigns to create a future of destruction for Los Angeles.  Every grave, unjust, or needless injury inflicted on The People or our great city through Garcetti's Memorandum will be the failure of Our Mayoral Servant himself, and each accomplice, including all City of Los Angeles servants who enacted and empowered this danger under their watch:
